Terms of use

Lucky Elephant Club (“the club”, “we”) runs this site: the Jungleverse, Ellyside Heights, the PBUTTA Factory, The Draw and the mint pages. It is an entertainment and community project.

• You must be 18 or older, or the age of majority where you live, to connect a wallet or take part.
• You may not use the site if you are in a country or region under sanctions, or where taking part would be against the law. You are responsible for following the laws and paying the taxes that apply to you.
• One person, fair play. Bots, scripts, multiple wallets used to game rewards, exploits and abuse of bugs are not allowed. We may hold, reverse or remove points, items, entries and rewards gained that way, and block wallets that do it.
• Names, bios, toasts and notes you write must not be hateful, harassing, illegal or impersonate anyone. We may remove them.
• Features, rewards, rates, prices, places and events can change, pause or end at any time, including if we need to protect the community or the ledger.
• The site is provided as it is, without warranties of any kind. It can have bugs, downtime and delays, and blockchains and wallets can fail. To the fullest extent the law allows, we are not liable for indirect or consequential losses, lost profits, or losses from blockchain, wallet, market or third party failures.
• We never ask for your seed phrase or private key and never message first asking you to sign. Anyone who does is not us.
• We may update these terms. The effective date above changes when we do, and using the site after that means you accept the update.

Risks of digital assets

Nothing on this site, in our posts, in Discord or in any video is financial, investment, legal or tax advice. Talk to your own advisors.

• Tokens and NFTs can lose some or all of their value. Prices can go up, down or to zero, and you can lose everything you put in.
• Markets for them can be thin. You may not be able to sell when you want, or at the price you want.
• Blockchain transactions are final. A transaction sent to the wrong address, signed by mistake or caught by a scam cannot be undone by us.
• Rules about digital assets differ by country and can change, and that can affect what you can do with them.
• Only spend what you can afford to lose.

PBUTTA

• PBUTTA earned in the Factory and in Ellyside Heights is held as in-game points on the club's ledger. Points have no cash value and cannot be redeemed for money from the club.
• The PBUTTA token is a utility token for use in the Lucky Elephant Club world. It is not an investment, a security, a share or a claim on the club or anyone in it, and it comes with no promise of value, profit or future price.
• The club does not run, set or guarantee any market or price for PBUTTA. Anything you buy, sell or trade outside this site is your own decision and at your own risk.
• Cash out (turning points into tokens) is offered when it is open, up to the limits shown, and can be paused or limited at any time. Minimums, daily limits and network fees apply.
• Points spent in town are spent for good. Holder rewards are capped at 350,000,000 PBUTTA in total, and the live ledger is public at /treasury.

NFTs

• Owning an NFT means you own that token on its blockchain. It does not transfer copyright or trademark rights in the art, the characters or the club's brand.
• While you hold an NFT you may use its image as a profile picture and for personal, non-commercial use. Commercial rights are not granted unless we announce them separately.
• Mints, reveals, collector drops and in-world perks can change, pause or end. A perk tied to holding an NFT ends when you no longer hold it.
• Royalties set on our collections apply to sales on marketplaces that honor them.

The Draw

• Draw tickets are bought with PBUTTA points earned on the site. Where a free entry is offered, it has the same chance of winning as any other ticket.
• Winners are picked from a Solana block that does not exist yet when the draw closes, so nobody, including us, can know or choose the result in advance. Every draw can be checked after it happens.
• Prizes are as described on each draw. We may swap a prize for one of similar value if the original cannot be delivered.
• Winners are responsible for any taxes on prizes. Draws are void where prohibited by law.

Games and contests

• Carnival and bar games are for Lil Elly Degen holders: scores tie into the town (mood, boards, prizes). Everyone else can watch the demos. Nothing is bought to enter a game, and nothing you pay for improves your score.
• Contests are decided by skill: the best checked score in the stated period (by default the calendar month, UTC) wins. Ties go to whoever posted first.
• A score goes on the board only when you sign it with your wallet. Every catch is checked against the round the server dealt. We may remove scores that look automated, scripted or exploited, and the wallets that posted them.
• Prizes, if any, are announced on X and Discord for each contest. Winners are responsible for any taxes, and contests are void where prohibited by law.

Privacy

We keep as little as the site needs to work.

• What we keep: your public wallet address, the actions you sign on the site, what you own and do in Ellyside Heights and the Factory, names, bios and notes you write, and your Discord ID if you link it.
• What we never collect: seed phrases, private keys, passwords or payment card details.
• Your browser keeps a few settings on your device (sound, volume, small preferences). We do not use advertising cookies.
• Services the site runs on may see technical data such as your IP address: hosting (Vercel), the database (Supabase), Solana and Ethereum data providers, and the wallet you connect with.
• Anything that happens on a blockchain is public and permanent, and is not something we can delete.
• Ask us in Discord to remove a name, bio or note you wrote, or to unlink your Discord account.
